Terms of Service
These terms are the agreement between you and WebNest Creations, Georgia, USA ("we", "us") for using RugbyMetrics, the website at rugbymetrics.com and the app at app.rugbymetrics.com (together, the "service"). By creating an account or using the service you agree to them. Please also read our Privacy Policy and, for clubs, the Data Processing Addendum.
1. Who can use the service
- You must be 18 or over. The service is not for children and a club may only add players who are 18 or over.
- If you create an account or an organisation for a club, union or other group, you accept these terms on behalf of that organisation and confirm you have the authority to do so. The person who creates the organisation is its owner.
- Keep your password safe. You are responsible for what happens under your account.
2. Plans, trial and payment
| Plan | Price |
|---|---|
| Free | No charge, one team, with the limits shown on our pricing page |
| Club | USD 49 a month or USD 490 a year |
| Club Plus | USD 99 a month or USD 990 a year |
| Custom | Agreed with us in writing |
- Every new organisation starts with a 60-day trial of everything. After the trial it moves to Free unless you have asked to upgrade.
- You can cancel at any time. Your plan then continues to the end of the period you have paid for and then moves to Free.
- When you move to a smaller plan, your data is not deleted. It is kept, within the limits of the plan: features and older records that the plan does not include are locked, not removed, and open again if you upgrade.
- Payment is by request and invoice at the moment. You ask for an upgrade in the app and we switch it on after confirming payment arrangements with you. No card number is taken on our website or in the app. Prices are in US dollars and may change for future periods; we will tell you before a change applies to you.
3. Refunds
We do not refund partial periods. This does not take away rights you have under the consumer law where you live, and those rights always apply — for example the 14-day right to withdraw for consumers in the United Kingdom and the European Union, the consumer guarantees under the Australian Consumer Law, and your rights under the Consumer Protection Act in South Africa.
4. What clubs must do
- Make sure you have a lawful basis to put each player's data into the service, and the player's consent where it is needed, in particular for health-type data (injuries, wellness, body measurements). The app records consent; keeping it accurate is your job.
- Enter only players aged 18 or over.
- Give only the right people the right role in the app.
- Answer your players' requests about their data. We provide tools to help, such as export and delete.
5. Not medical advice
Injury records, readiness, wellness, body composition and training-load figures in RugbyMetrics are guidance to help coaches and staff plan. They are not a diagnosis, treatment or medical advice. Always consult a qualified medical or sports-science professional about a player's health, injury or return to play.
6. Acceptable use
You must not: break the law or others' rights; upload data you have no right to use; try to get into accounts, data or systems that are not yours; test our security without our written permission; overload or interfere with the service; copy or resell the service; or use it to harass or discriminate against anyone. We may remove content or restrict access that breaks these rules.
7. Ownership and licences
- Your data stays yours. Clubs own the data they put in. You give us a licence only to host, process, copy (for backup) and display that data as needed to run the service for you. We do not use it for advertising.
- RugbyMetrics — the software, design, text and brand — belongs to us and our licensors. We give you a limited, non-exclusive right to use the service while you follow these terms.
- If you send us feedback or ideas, we may use them without owing you anything.
8. Availability
The service is provided "as is" and "as available". We work to keep it running, but there is no uptime guarantee on the Free plan, and we may change or pause features. Features that work offline may rely on your device's storage; keep your device and browser up to date.
9. Limits on our liability
To the fullest extent the law allows, we are not liable for indirect or consequential loss, loss of profit, or loss of data you could have backed up (you can export your data at any time). Our total liability to you for anything arising from the service is limited to the fees you paid us in the 12 months before the claim, or USD 100 if you are on the Free plan. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury resulting from negligence or for fraud, or removes rights you have under mandatory consumer law.
10. Suspension and ending
- You can stop using the service at any time and delete your account or organisation yourself (see the Privacy Policy). Export your data first: Settings → My data for players, Team settings → Organisation for owners. Deleting an organisation is permanent after a 30-day read-only period.
- We may suspend or end access if you seriously or repeatedly break these terms, or if the law requires it. Where we reasonably can, we give notice and time to export your data first.
11. Governing law
These terms are governed by the laws of the State of Georgia, USA, and disputes are for the courts of Georgia, without removing any mandatory consumer protection you have under the law of the country where you live, including your right to bring a claim in your local courts where that law gives it to you.
12. Changes to these terms
We may update these terms. We will change the version number and date above, and for a material change signed-in users will see a notice in the app the next time they sign in. If you keep using the service after a change takes effect, you accept it. If you do not agree, you can export your data and stop using the service.
